1. General

Haus Properties Inc. [Haus] is an incorporated company registered in Ontario, Canada.  Clients applying to rent preperty are referred to as 'the Applicant' until such time as they take up residence when they are referred to as 'the Tenant'.  Haus act only as property managers for the owners of the property 'the Owners', therefore any contract is between the Owners of the property on one part and the Applicant or Tenant on the other.

2. Reservation, Deposit and Final Payment

A property is deemed to be 'reserved' once Haus has received a rental application which has been unconditionally accepted and the agreed upon Deposit has been received and cleared by the Haus' bank.

(a) Deposits for Home and Condo Rentals are first and last months rent.  The last months rent shall be held as a security deposit.  Monthly rent is due on the first day of each month.  Post dated cheques will be required for each month's rent for the term of the tenancy.

(b) Deposit for Cottages + Retreats is 25% of the total rental fee.  The balance of the total rental fee is due 15 days prior to the commencement of the rental period failing which the Agent has the right to cancel the booking, keep the deposit and rebook the property.

In the event of a booking not being accepted by Haus, all fees paid will be refunded immediately or as soon as reasonably possible.

3. Cancellation

When a deposit has been received the booking is considered confirmed.  Cancellations by the Applicant must be made in writing.  If the rental period of your rental can be rebooked, you will receive a refund for the period rented, less a cancellation fee of $150.00.  If any part of the rental period cannot be rebooked, you will forfeit all monies paid for that period.

4. Optional Extras

These are listed in the description of each property and will be charged at the rates shown.

5. Price Changes

Haus reserves the right to amend prices quoted on the web site due to errors or omissions.

6. Method of Payment

Payments are to be made by cheque, payable to Haus Properties Inc.. If a booking is made within 15 days of the start of the rental period, only a certified cheque or cash is acceptable.    Any charges raised against Haus by their bank, for handling dishonored cheques, or bank transfers, will be passed onto the Applicants who are liable to reimburse Haus in respect of such charges within 7 days of receipt of notification from Haus.  

7. Eligibility

Haus reserves the right to make the final decision as to the acceptance of the booking.

8. Tenants' Obligations

  1. To pay for telephone charges incurred during the tenancy
  2. To pay for any losses or damages to the property, caused by the Tenant or member of their party (reasonable wear and tear excluded)
  3. To take good care of the property and leave it in clean and tidy condition at the end of the tenancy.  A cleaning service is not provided during the tenancy unless otherwise specified
  4. To permit the Owners and Haus reasonable access to the property
  5. Not to part with possession of the property, or share it, except with members of the party shown on the Rental Contract
  6. Not to exceed the total number of people stipulated in the property description and included on the Rental Contract
  7. Not to cause an annoyance, excessive noise or become a nuisance to occupants of ajoining premises or lands, as the case may be 

9. Non-availability of Property

If for any reason beyond the Owner's control the property is not available on the date booked (owning to fire damage for example), or the property is unsuitable for letting, all rent and charges paid in advance by the Applicants will be refunded in full and the Applicants shall have no further claim against the Owners or Haus.

10. Liability

Haus does not accept liability for any act, neglect on the part of the Owners or any other person not within their employ or otherwise under their control, nor for any accident, damage, loss, injury, expense or inconvenience, whether to person or property, which the Tenants or any person may suffer or incur arising out of, or in other way connected with the rental.  In addition, the Owner accepts no liability for loss or damage to the Tenant's possissions on the Owner's property or land.

11. Complaints

All complaints must be notified to Haus or Owners immediately so that an immediate investigation can be made if necessary and remedial action to be taken if required.  In no circumstances will compensation be made for complaints raised after the tenancy has ended when the Tenant has denied Haus or Owners the opportunity of investigating the complaint and endeavoring to put matters right during the tenancy.

12. Pets

Pets are only permitted with the prior written consent of Haus or Owners and where permitted are to be kept under control and exercised off the premises.  If written consent is given to the Tenant, by Haus or Owners, for the pet to be on premise, the pet is not permitted in the bedrooms or on the furniture and neither Haus nor the Owners can accept responsibility for their safety.  A weekly charge may be made for each pet.  Pets being excluded in a description does not guarantee there have been no pets at the property. 

13. Inventory

Upon check-in please cross check the property's actual on-site inventory to the Property Checklist (paperwork found on kitchen counter).  Any inventory discrepancies are to be reported to the Owner within 24 hours of arrival, otherwise the on-site inventory will be deemed to be correct.

14. Breach of Contract

If there shall be a breach of any of these conditions by any of the Tenants, the Owners or Haus reserve the right to re-enter the property and terminate the tenancy without prejudice to the other rights and remedies of the Owners. 

15. Authority to Sign

  1. He or she is authorized to agree to the Terms and Conditions on behalf of all persons included in the Rental Agreement, including those substituted at a later date
  2. Signatory is over 18 years of age and a member of the party intending to occupy the property
  3. He or she agrees to take full responsibility for the party occupying the property
